TRAVELLER AGREEMENT | VERSION 1.0

IMPORTANT — PLEASE READ CAREFULLY
By making any payment to Triptoniq — whether a deposit or full amount — you confirm that you have read, understood, and unconditionally accepted all terms in this Agreement. Payment constitutes a legally binding acceptance under the Information Technology Act, 2000, and any OTP authenticated during payment serves as your electronic signature of assent. Triptoniq will retain a timestamped record of all transactions as conclusive evidence of acceptance.
1. ACCEPTANCE OF TERMS & BOOKING VALIDITY
- Payment as Agreement: Any payment — deposit or full amount — constitutes formal acceptance of these terms and a digital signature under the IT Act, 2000. Triptoniq retains a timestamped record as conclusive evidence.
- Checkbox Confirmation: Customers must actively tick a confirmation checkbox at online booking. Booking cannot be completed without this step. Gateway logs are admissible as conclusive proof.
- Age & Legal Capacity: Traveller must be 18+. Bookings for minors must be made by a parent/guardian who accepts these terms and submits a signed Minor Travel Consent Declaration with photo ID.
- KYC Compliance: Valid PAN card and/or Aadhaar required for all international bookings per RBI and LRS guidelines. Confirmation may be withheld until KYC is received.
- Minimum Occupancy: Prices based on twin-sharing. If a traveller becomes solo due to a companion’s cancellation, a non-negotiable Single Supplement charge applies.
- Version Governance: The version in force at the time of booking governs that booking. Amendments apply only to future bookings
2. PAYMENTS, TAXES & REFUNDS
- TCS: A mandatory 2% TCS applies to international package cost per GOI 2026 regulations. May be claimed as income tax credit by the traveller.
- Payment Deadlines: Full balance due 30 days before departure. Failure results in automatic cancellation and forfeiture of deposit.
- No-Show Policy: 100% cancellation charges apply. Exception only for documented medical emergencies with hospital records submitted within 48 hours.
- Cancellation Charges:
- 61+ days: 10% of total package cost
- 31–60 days: 25% of total package cost
- 15–30 days: 50% of total package cost
- 0–14 days: 75% of total package cost
- No-Show / Day of Departure: 100% of total package cost
- Non-Refundable Components: Visa fees, airline tickets, and advance hotel deposits may be entirely non-refundable regardless of the above slabs.
- Chargeback Waiver: Traveller agrees not to initiate any credit card or payment gateway chargeback. All disputes must go through arbitration (Section 10).
- Refund Processing: Approved refunds processed within 21 working days via the original payment method.
3. DOCUMENTATION, VISAS & INSURANCE

Visa Responsibility: Triptoniq is a facilitator only. Visa rejections attract 100% cancellation charges on non-refundable components.

Passport Validity: Must be valid for at least 6 months beyond the return date.

Travel Insurance: Strongly recommended. Standard coverage up to age 70. Travellers above 70 must obtain independent coverage or pay a senior supplement.
4. FORCE MAJEURE & LIABILITY
- Definition: Acts of God, pandemics, emergencies, government travel bans, war, terrorism, civil unrest, natural disasters, or supplier insolvency beyond Triptoniq’s control.
- Effect: Triptoniq obligations suspended during force majeure. Reschedule or credit note offered; cash refunds subject to supplier recovery and may be partial.
- Liability Cap: Triptoniq’s total liability shall not exceed the total net amount paid by the customer for the specific booking, excluding TCS and third-party charges.
- Third-Party Defaults: Triptoniq acts as agent for airlines, hotels, and transport providers. Not liable for their negligence or insolvency. Recourse lies directly with the supplier.
5. HEALTH, CONDUCT & SAFETY

Medical Disclosure: All pre-existing conditions, physical limitations, and dietary requirements must be disclosed at booking. Failure constitutes material misrepresentation.

Tour Manager Authority: Tour Manager’s decisions on all operational matters are final and binding. Their authority must be respected at all times.

Code of Conduct & Removal: Zero tolerance for abuse, aggression, harassment, or disruptive intoxication. Removed travellers forfeit all amounts paid with no refund. Decision is at Triptoniq’s sole discretion.

Punctuality: 5-minute buffer applies to group departures. Costs to rejoin the group are entirely the traveller’s responsibility.
6. DIGITAL COMMUNICATIONS & WHATSAPP

Valid Notice: Communications to the registered mobile number or email constitute valid legal notice for all purposes under this Agreement.

Traveller Obligations: Traveller is responsible for keeping registered contact details active. Triptoniq is not liable for losses from missed communications.
7. DATA PRIVACY — DPDP ACT 2023
- Collection & Purpose: Data collected solely to deliver travel services. Not sold to third parties.
- Marketing Consent: Traveller may withdraw consent for marketing use of data or photos at any time by contacting privacy@triptoniq.com.
- Media & Photography: Triptoniq may capture photos/video for promotional use. Opt-out must be notified in writing to the Tour Manager at the start of the tour.
- Retention: Data retained for 7 years for legal and regulatory compliance.
8. INTELLECTUAL PROPERTY
- Triptoniq’s brand, logo, itineraries, and content are its exclusive intellectual property. No commercial reproduction without prior written consent.
9. MISCELLANEOUS PROVISIONS
- Waiver: Non-enforcement on one occasion does not waive future rights.
- Severability: Invalid provisions do not affect the remaining Agreement.
- Entire Agreement: Supersedes all prior representations and understandings.
- Language: English version prevails in case of conflict with translations.
10. DISPUTE RESOLUTION & JURISDICTION
- Pre-Litigation Notice: 30-day written notice required before filing any claim or arbitration demand.
- Mandatory Arbitration: Unresolved disputes go to binding arbitration under the Arbitration and Conciliation Act, 1996. Seat: New Delhi. Language: English. Sole arbitrator mutually appointed.
- Jurisdiction: Exclusive jurisdiction vested in competent courts of New Delhi, India.
- Class Action Waiver: All claims must be brought individually. No class-wide or representative claims permitted.
- Governing Law: Laws of the Republic of India.
